OPSS issues Compliance Notices to CVS Energy Ltd

The Office for Product Safety and Standards (OPSS) has recently issued two Compliance Notices (dated 21st August 2024) to CVS Energy Ltd t/a Clearview Stoves.

The first of these Notices, served under Regulation 13(b) and Schedule 5, para ​2​(1)(a) of the Ecodesign for Energy-Related Products Regulations 2010 states that the manufacturer is in breach of Regulation 14(1) of Ecodesign for Energy-Related Products Regulations 2010 by failing “to make all relevant technical information and documentation including Declarations of Conformity for the above products, available for inspection by OPSS.”.

The second Notice, served under Regulation 6(d) and Schedule 4, paras ​1​ and 3 of the Energy Information Regulations 2011 states that the manufacturer is in breach of Regulation 11(1)(b) of the Energy Information Regulations 2011 for the same reasons.

Both Notices are in relation to 10 stove models.

A business is required to take action within a specific period when served with a Compliance Notice by the OPSS. The standard of proof required to issue a Compliance Notice is the same as that required in criminal prosecution.

Clearview Stoves is not a member of the Stove Industry Association.
